1. Acceptance of Terms
By accessing or using the samurai/mcp service ("Service") operated by samurai/mcp (the "Operator") at mcp.Samurai.xyz, you ("Customer") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Service Description
The Service provides hosted Model Context Protocol (MCP) server endpoints addressable over JSON-RPC/HTTP, intended for developers integrating MCP into AI agents. The Service exposes deterministic caches, consensus gates, and causal memory as metered API endpoints.
3. Acceptable Use
Customer shall not:
- transmit spam, malware, or content that violates law;
- operate malicious agents (credential stuffing, scraping protected systems, denial-of-service);
- resell, sublicense, or white-label the Service without prior written permission;
- reverse-engineer rate limits or circumvent metering;
- use the Service to generate content that infringes third-party rights.
The Operator may suspend any account violating this section without prior notice.
4. User Responsibilities
Customer is responsible for:
- keeping API keys confidential — any call made with a Customer's API key is attributed to that Customer;
- securing the systems from which API calls originate;
- compliance with all laws applicable to Customer's use of the Service.
5. Fees and Billing
- Free tier: 100 calls per calendar month at no charge.
- Metered tier: $0.0005 – $0.005 per call depending on endpoint, charged via Stripe.
- Billing cycle: monthly, invoice generated on the 1st UTC for the prior month.
- Failed payments may result in suspension after 7 days' notice.
- Prices may change with 30 days' notice via email.
6. Termination
Either party may terminate at any time. Customer may delete their account via the dashboard or by emailing support@Samurai.xyz. The Operator may terminate immediately for breach of Section 3 or non-payment. Upon termination, Customer's data is deleted within 30 days, subject to legal retention requirements.
7. Limitation of Liability
To the maximum extent permitted by law, the Operator's aggregate liability arising out of or related to the Service shall not exceed the total fees paid by Customer to the Operator in the twelve (12) months preceding the event giving rise to the claim. The Operator shall not be liable for indirect, incidental, consequential, special, or punitive damages.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE OPERATOR DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes shall be resolved in the state or federal courts located in Delaware. (Founder will revise jurisdiction upon entity formation.)
10. Changes to Terms
The Operator may modify these Terms by posting an updated version at this URL and emailing registered Customers at least thirty (30) days before the effective date. Continued use after the effective date constitutes acceptance.
